Penalty with points deducted: who reports the driver’s details?

If the driver was not identified, the vehicle’s registered keeper must send the requested details to the authority within the deadline stated in the notice.

If a penalty notice does not identify the driver and includes a points deduction, the registered keeper or other person named as responsible must report the driver’s details to the enforcement authority. Check the deadline and submission method in the notice, and keep proof that you sent it.

Find the notice and deadline

Check whether the offence carries a points deduction and whether the driver was identified at the time. If not, Article 126-bis requires the registered keeper or another person liable to provide the personal details and licence information of whoever was driving. This is separate from paying the fine.

The notice gives the enforcement authority, submission method and deadline. The Highway Code sets a time limit, but the precise calculation depends on the date and how the notice was served. Do not wait for the points balance to appear on the Portal: the duty to provide the information may arise before the balance is updated.

Send accurate details and keep proof

Prepare the name and address details and licence information of the person who was driving at the time. Send them through the official channel specified by the authority, complete every required field and attach the requested documents. If a company owns the vehicle, the law assigns the duty to its legal representative or delegate.

Keep a copy of the submission, delivery receipt or protocol number, and the penalty notice. If the addressee has changed, the details do not match or you are unsure who drove, contact the enforcement authority immediately using its official contact details. Do not name someone else to avoid points: the information must be truthful.

What happens next

After receiving the details, the authority records them and, once the case is final, applies the deduction to the driver register. The registered keeper may face a separate penalty for failing to provide the details without a justified, documented reason. Paying the fine does not replace the information request.

If you believe the notice is wrong, check the appeal options and deadlines before acting: an appeal and the duty to identify the driver may have different time limits. For your case, read the current legislation and seek qualified advice; an informal phone call does not automatically suspend a deadline.
