How long may you stay in an Italian motorway emergency bay?
Only for an emergency and only as long as necessary, up to three hours; use a service area for an ordinary break.
On an Italian motorway, stop in an emergency bay or lane only when there is an emergency. The stop must last no longer than necessary and, in any case, no more than three hours. For an ordinary break, continue to a service area or parking area.
Emergency bays are reserved for emergencies
On motorway carriageways, ramps, and interchanges, stopping or parking is prohibited except for emergencies caused by illness or a vehicle fault. In that case, move the vehicle as soon as possible to the emergency lane or, if there is none, the first available bay in the direction of travel.
An emergency bay is for a vehicle that cannot continue safely or for an urgent health problem. It is not an alternative parking spot, a place to enjoy the view, or somewhere to check a phone. For a planned rest, use a service area or designated parking area instead.
How long can an emergency stop last?
Article 176 says the emergency stop must last only for the time strictly necessary to resolve the problem and may not exceed three hours. The three-hour period is an absolute maximum, not an allowance for an ordinary break. If the vehicle is ready to move earlier, leave the emergency area as soon as it is safe.
If the fault requires help, contact roadside assistance and follow the operator’s instructions. Keep people away from moving traffic and use the designated safety measures. A vehicle left after the emergency is over can obstruct others who need the bay and may be removed under the law.
Choose the right place for a break
Service areas and parking areas are provided for planned stops, fuel, food, and rest. Check the signs and continue there if you are tired or need time away from driving. Do not use an emergency bay simply because the next service area is farther than expected.
If your vehicle begins to malfunction, leave the live lane carefully and stop at the nearest safe emergency location. The purpose and duration of the stop matter: a genuine emergency justifies temporary use, while convenience does not.

Frequently asked questions
Does the three-hour limit mean I may take a three-hour break there?
No. The stop is allowed only for an emergency and only for the time needed to resolve it; three hours is the maximum, not a routine allowance.
Where should I stop for a normal rest?
Use a motorway service area or a designated parking area, not an emergency bay.
